Countdown to the Ball Drop Sweepstakes Rules
NO PURCHASE NECESSARY. A purchase does not increase your chances of winning. Void where prohibited. Open to legal residents of the 50 United States and the District of Columbia, 18 years or older. Internet access is required.
1. Eligibility: Open to legal residents of the 50 United States and the District of Columbia, 18 years or older at the time of entry. Employees, officers and directors of Philips Lighting Company (Sponsor), its parent, affiliated and subsidiary companies, advertising and promotional agencies, and members of the immediate family or household of the employees of such entities are not eligible. (Immediate family includes the spouse and parents, siblings and children and their spouses whether or not residing with the ineligible employee.) Void in Puerto Rico and where prohibited.
2. Sweepstakes Period: The Make Your New Year Sparkle Sweepstakes begins at 12:00:01 AM Eastern Time (ET) on December 28, 2012 and ends at 11:59:59 PM ET on January 3rd, 2013 (the Entry Period). Sponsor’s computer shall be the official timekeeping device for this Sweepstakes.
3. How to Enter: Entrants must first be following Sponsor’s Twitter handle (@philipslightus). To enter, entrants must tweet a brief description of how light makes their New Year celebrations special, or how light would enhance their New Year celebrations, including #
PhilipsNYECountdown in the tweet, during the Entry Period. Should an entrant fail to include the #
PhilipsNYECountdown hashtag to a tweet, they will not be successfully entered into the Sweepstakes. If you post updates to or receive updates from Twitter via SMS from your wireless phone, your wireless service provider may charge you for each text message you send and receive. Please consult your wireless service provider for more information. All terms and conditions of Twitter.com apply. Entries must be received by 11:59:59 PM ET on January 3rd, 2013. Any person who attempts to participate with multiple handles, under multiple identities or uses any device or artifice to enter more than once will be disqualified. Automated submission of entries (including but not limited to entries made using any script, macro, bot or sweepstakes service) will be disqualified and transmissions from any related e-mail or IP addresses may be blocked. Retweets of any Sweepstakes entry do not count as an additional entry. Limit one entry per Twitter handle per person.
4. Drawing: A random drawing from among all eligible entries received during the Sweepstakes Period will be conducted on or about January 4th, 2013 by Forum Strategies, an independent judging organization. One (1) grand-prize winner will be selected, and two (2) runner-up winners will be selected. Odds of winning will depend on number of eligible entries received.
5. Prizes/ARV (Approximate Retail Value: One (1) Grand Prize consisting of a Philips home entertainment lighting package, with a retail value of $1,500, or option of a check in the amount of $1,500. Two (2) runner-up prizes consist of a Philips home entertainment lighting package, with a retail value of $500 or option of a check in the amount of $500. Odds of winning depend on the number of entries received.
6. Notification: The winner will be notified using contact information provided or collected at the time of entry, after random selection on or about January 4th 2013. Winners will be announced via a message from Sponsor's official Twitter account (@philipslightus). Sponsor will attempt to contact the Winners via a public Tweet from the
@philipslightus Twitter handle. Sponsor, in its sole discretion, may also attempt to contact the Winners via a direct message on the Twitter platform.
Winners will be required to complete and sign an Affidavit of Eligibility, a Liability Release, and, where permitted, a Publicity Release, and return these documents within the time specified in the notification letter. Tennessee residents need not sign publicity release. Failure by a winner to timely complete, sign and return the documents or the return of any prize notification as undeliverable will cause prize to be forfeited and awarded to an alternate winner.
7. Prize Restrictions: Prizes are non-transferable and no substitution will be made except at the Sponsors sole discretion. Sponsor reserves the right, at its sole discretion, due to prize unavailability or for any reason to substitute all or part of a prize with one of comparable or greater value. Winner is solely responsible for payment of all applicable federal, state and local taxes on prize and for all other expenses related to acceptance and use of prize not specifically stated herein. Prize winner will be issued an IRS 1099 Form for the fair market value of the prize.
8. General: By entering, participants (a) agree to be bound by the Official Rules and the decisions of the Sponsor and judges which are final and binding in all respects; (b) to release, discharge and hold harmless Sponsor, Forum Strategies and their affiliates, parent companies, subsidiaries, advertising and promotion agencies, and their respective officers, directors, employees, representatives and agents (Sweepstakes Entities) from and against any and all liability, injuries, losses, damages, rights, claims and actions of any kind, including personal injury and/or death or property damage, in any way arising from his/her participation in this Sweepstakes, or from his/her receipt, possession, acceptance and/or use or misuse of any prize, or for any error in the announcement of any prize; (c) that the foregoing Sweepstakes Entities have neither made nor are in any manner responsible or liable for any warranty, representation or guaranty, expressed or implied, in fact or in law, relating to a prize; and (d) if a winner, by accepting prize, to the use of his/her name, photograph and/or likeness by Sponsor, or any party authorized by Sponsor, for advertising and promotional purposes in all media without review or additional compensation (except where prohibited by law) and, upon request, to provide such consent in writing.
Sponsor, its parent, affiliates, subsidiaries, advertising and promotion agencies, agents and representatives and their respective officers, directors and employees are not responsible for and shall not be liable for: (a) printing or typographical errors in any Sweepstakes-related materials, (b) electronic, hardware or software program, network, Internet or computer malfunctions, failures, or difficulties of any kind, including without limitation, server malfunction or by any human error which may occur in the processing of entries; (c) failed, incomplete, garbled or delayed computer transmissions; (d) lost, late, misdirected, mutilated, incomplete or illegible prize claims and/or entries; or (e) any condition caused by events beyond the control of the Sponsor that may cause the Sweepstakes to be disrupted or corrupted.
Sponsor reserves the right, in its sole discretion, to modify, suspend or terminate the Sweepstakes or any portion thereof should viruses, bugs technical difficulties, suspected or actual electronic tampering, or other causes corrupt the administration, security integrity or proper play of the Sweepstakes. In the event of cancellation or suspension, notification thereof will be posted within the site “www.ledlighting.com” and the prize will be awarded based on a random drawing from among all eligible on-line entries received prior to cancellation. Sponsor, at its sole discretion, reserves the right to void any entries submitted fraudulently or in contravention of the Official Rules. CAUTION: ANY ATTEMPT BY A SWEEPSTAKESANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH OFFENDER TO THE FULLEST EXTENT PERMITTED BY LAW.
In the event of a dispute as to the identity of an on-line entrant, the e-mail address used to participate in the Sweepstakes at the actual time of entry will be deemed to be the entrant. Authorized account holder is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g. business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the Twitter handle associated with the submitted e-mail address or phone number. Proof of being the authorized account holder may be required.
9. Individual Entry Only: Every entry must be manually keystroked and entered by an individual entrant. Automated submission of entries (including but not limited to entries made using any script, macro, bot or Sweepstakes service) will be disqualified and transmissions from any related e-mail or IP addresses may be blocked. Sponsor may reject any entry it believes is the result of fraud or was submitted in violation of the Official Rules. A screen shot is not evidence of winning a prize.
10. Governing Law: This Sweepstakes will be governed by the laws of the State of New Jersey, without regard to its choice of law or conflict of laws principles. Any and all disputes arising out or connected in any way with the Sweepstakes will be resolved individually and exclusively by final and binding arbitration administered by the American Arbitration Association (AAA) conducted before a sole arbitrator and held in New Jersey. Arbitrators decision shall be controlled by these Official Rules and shall apply only to the individual initiating the dispute. Arbitrator shall not have the power to award special, consequential, incidental, punitive or other similar damages.
