INTERNET ACCESS AND A TWITTER ACCOUNT REQUIRED. TWITTER IS NOT A SPONSOR OF THIS PROMOTION.
TIMING. The ZipRealty, Inc. (“ZipRealty” or “Sponsor”) “Shout-out ZipListed and Get Lucky!” Sweepstakes (“Sweepstakes”) begins on Thursday, June 27, 2013 at 9:00:00 am Pacific Time (“PT”) and ends on Thursday, June 27, 2013 at 4:59:59 pm PT (“Sweepstakes Period”). All activities for entries must be completed during the Sweepstakes Period to be eligible. OneKontest, the Sweepstake’s Administrator (“Administrator”), and its computer shall be the official timekeeper for all matters related to the Sweepstakes.
ELIGIBILITY. The Sweepstakes is open to legal U.S. residents 18 years of age or older at the time of entry who have Internet access as of June 27, 2013 (“Entrant”). Employees, directors, partners, affiliates or other entities (and their respective dependents, immediate family members and individuals residing in their same household) that are affiliated with Sponsor or Administrator other than licensed ZipRealty Agents and Brokers as of June 27, 2013 are not eligible to enter or win. Sponsor reserves the right to verify eligibility at any time. The Sweepstakes is void where prohibited or restricted by law. All federal, state and local laws apply.
AGREEMENT TO OFFICIAL RULES. Participation in the Sweepstakes constitutes Entrant’s full and unconditional agreement to and acceptance of these Official Rules and all decisions of Sponsor.
TO ENTER. To participate in the Sweepstakes, Entrant must have a Twitter account and be a follower of
@ZipRealty on Twitter.com.
If Entrant already has a Twitter account, go to http://twitter.com and log on using your Twitter user name and password, then become a follower of
@ZipRealty by searching for “@ZipRealty” clicking on the “@ZipRealty” icon and then clicking the “Follow” button.
If you do not have a Twitter account, go to http://twitter.com and create a Twitter account according to the instructions on the website and then become a follower of
@ZipRealty as directed above. Creating a Twitter account is free. Please note that Entrant must agree to comply with the Twitter Terms of Service in order to create a Twitter account.
Once Entrant becomes a follower of
@ZipRealty, you will be required to submit a “Tweet” with the following message (“Statement”): “Get #
ZipListed with
@ZipRealty! Check out the new Seller Center & enter to win a $75 gift card! http://bit.ly/ziplisted for entry & rules.” Alternatively, once Entrant reaches the Administrator’s landing page for the Sweepstakes, Entrant can click on the “Tweet to enter!” action button to enter the Statement. Limit one (1) Twitter entry per person/Twitter account during the Sweepstakes Period. Entries with the Statement must be received within Sweepstakes Period to be eligible. Multiple entrants on one Twitter account and anyone found to use multiple accounts to enter will be ineligible.
Any false or deceptive entries or acts will render the Entrant ineligible. Any attempted form of entry other than as described in these Official Rules is void. Sponsor reserves the right in its sole discretion to disqualify any Entrant it finds to be tampering with the operation of the Sweepstakes or to be acting in violation with these Official Rules. Proof of submitting an entry will not be deemed to be proof of receipt by Sponsor. Every submission must be manually key stroked and manually entered by the individual participant and repetitive automated electronic submission of entries (including but not limited to entries submitted using any bot, script, macro, or sweepstakes service) are specifically disallowed.
PRIZE DRAWING. On June 27, 2013, one (1) winner will be randomly selected from all eligible entries every two (2) hours during an eight-hour period for a total of four (4) prize winners. At 11:00 am PT on June 27, 2013, one (1) prize winner will be selected at random from all eligible entries received by 11:00 am PT. At 1:00 pm PT on June 27, 2013, one (1) prize winner will be selected at random from all eligible entries received by 1:00 pm PT. At 3:00 pm PT on June 27, 2013, one (1) prize winner will be selected at random from all eligible entries received by 3:00 pm PT. At 5:00 pm PT on June 27, 2013, one (1) prize winner will be selected at random from all eligible entries received by 5:00 pm PT.
Winning is contingent upon fulfilling all requirements of these Official Rules including eligibility requirements. To win a prize, the potential winner must be a follower of
@ZipRealty at the time of the random drawing and when the potential winner is notified. Sponsor will notify the potential winners by Private Message through Twitter. If a potential winner cannot be reached by Private Message within two (2) days of the first notification attempt, then the potential winner will be disqualified and an alternate potential winner will be selected from the remaining eligible entries for the applicable drawing. Once a potential winner has responded to the Private Message notification, the potential winner will be sent additional verification paperwork such as an Affidavit of Eligibility and a Publicity/Liability Release (except where prohibited by law) and a Form W-9 via email, postal mail, and/or express mail at Sponsor’s sole discretion. If Sponsor does not receive the signed paperwork within five (5) days of delivery, then the prize may be forfeited. Where a prize is forfeited, an alternate potential winner will be chosen at random from the remaining eligible entries. Drawings will continue until the prize has been awarded. Sponsor’s decision as to the administration of the Sweepstakes and prizes awarded is final.
PRIZES. Each Prize consists of one (1) $75 voucher to giftcertificates.com. Total value of all prizes is three-hundred dollars ($300).
By accepting the prize, the prize winner acknowledges receipt of and compliance with these Official Rules. All taxes on the prizes are the sole responsibility of the winner. Sponsor will not replace any portion of a lost or stolen prize once it has been mailed to the winner. The prizes are non-transferrable. No prize substitution or cash equivalent allowed by winner.
ODDS OF WINNING. Odds of winning a prize depend on the total number of eligible entries received.
GENERAL TERMS AND CONDITIONS. Sponsor reserves the right to cancel, modify or suspend the Sweepstakes should fraud, technical failures, or any other factor beyond the reasonable control of Sponsor impair the integrity of the Sweepstakes, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right to award the prizes from the eligible submissions received up to the time of impairment. Except where prohibited by law, participation in the Sweepstakes constitutes winner’s consent to Sponsor’s use of their names, city and state of residence, likeness, photograph, image and winning entry, in whole or in part, for advertising, publicity, and promotional purposes in any media, online or offline, without further permission, consent, payment or other consideration. These Official Rules shall be governed by and construed under California law without regard to conflicts of law provisions. The failure of Sponsor to act with respect to a breach of these Official Rules by entrants or others does not constitute a waiver and shall not limit Sponsor's rights with respect to such breach or any subsequent breaches. Entrants agree that entrants are bound by Sponsor’s Terms of Use located at www.ziprealty.com. The entry information provided is subject to the Privacy Policy located at www.ziprealty.com.
LIMITATION OF LIABILITY. Sponsor and Administrator are not responsible for and shall have no liability for lost, late, illegible, misdirected or incomplete, entries or email or for interrupted or unavailable satellite, network, server, Internet service provider, Internet access provider or online service provider (collectively referred to as “ISP”), website, telephone or other connections, availability or accessibility, or miscommunications, or failed computer, satellite, telephone or cable transmissions, or lines, or technical failure or jumbled, corrupted, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures, or technical errors or difficulties, or other errors of any kind whether human, mechanical, publishing, printing, electronic or network errors or the incorrect or inaccurate capture of user IDs, password, entry or other information or the failure to capture, or loss of, any such information. Persons who tamper with or abuse any aspect of this Sweepstakes, as solely determined by Sponsor, will be disqualified. Sponsor and Administrator are not responsible for injury or damage to Entrant’s or to any other person’s computer, smartphone, or tablet related to or resulting from participating in this Sweepstakes or downloading materials from or use of the website. Should any portion of the Sweepstakes be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention, technical failures or other causes which, in the sole opinion of Sponsor, corrupt or impair the administration, security, fairness, or submission of entries, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Sweepstakes, and to conduct the random drawing from entries received prior to such action taken or as otherwise deemed fair and appropriate by Sponsor. Sponsor and Administrator are not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes, and assumes no responsibility for any error, interruption, deletion, defect, delay in operation, or transmission, communications line failure, theft or destruction, or unauthorized use to the website. IN NO EVENT WILL SPONSOR AND ADMINISTRATOR, THEIR RESPECTIVE PARENTS, SUBSIDIARIES AND AFFILIATED COMPANIES, THEIR RESPECTIVE ADVERTISING OR PROMOTION AGENCIES OR ANY OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF ENTRANTS’ ACCESS TO AND USE OF THE WEBSITE AND MOBILE APPLICATIONS OR DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM THE WEBSITE OR MOBILE APPLICATIONS. WINNER AND OFFICIAL RULES. A copy of these Official Rules and the Sweepstakes results may be obtained by sending a self-addressed stamped envelope to: ZipRealty “Shout-out ZipListed and Get Lucky!” Sweepstakes - Results, 2000 Powell Street, Suite 300, Emeryville, CA 94608. Sweepstakes results will be available after July 27, 2013. Requests must indicate the specific Sweepstakes requested, and must be received no later than August 10, 2013.
