NO PAYMENT, ENTRY FEE OR PURCHASE REQUIRED.
OPEN TO RESIDENTS OF THE FORTY-EIGHT (48) CONTIGUOUS UNITED STATES (EXCLUDING ALASKA AND HAWAII), THE DISTRICT OF COLUMBIA AND CANADA, EXCLUDING QUEBEC, WHO ARE REGISTERED TWITTER USERS. ENTRANTS MUST BE AT LEAST EIGHTEEN (18) YEARS OLD AT TIME OF ENTRY AND MUST OWN OR HAVE FREE ACCESS TO WWE MERCHANDISE OR MEMORABILIA ON OR BEFORE OCTOBER 23, 2012. VOID WHERE PROHIBITED.
HOW TO ENTER: WWE/Doomsday Preppers Photo Sweepstakes (the “Sweepstakes”) begins at 10:00 a.m. (ET) on October 23, 2012 and ends at 10:00 p.m. (ET) on November 14, 2012 (the “Sweepstakes Period”). Fans are asked to take a photograph of themselves in response to the following question: If the world were to end tomorrow, what is the one (1) piece of WWE memorabilia that you could not live without.” Submit your photo entry by visiting onekontest.com/wwepreppers and following the “Tweet to enter!” instructions. Eligible entries received during the Sweepstakes Period will be entered for a chance to win a prize in this Sweepstakes.
Limit one (1) entry per person /email address over the entire Sweepstakes Period. Sponsor’s computer is the official time keeping device for this Sweepstakes.
All photos and entries become the sole property of WWE and will not be acknowledged or returned. Entries will be declared made by the authorized account holder of the e-mail address or telephone number submitted at the time of entry. “Authorized account holder” is defined as the natural person who is assigned to the e-mail address by an Internet access provider, on-line service provider, or other organization (such as a business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address, or who is assigned a phone number by a phone service provider or other organization that is responsible for assigning phone numbers associated with the submitted phone number. The authorized account holder may be required to provide proof of identity. If a dispute cannot be resolved, the entry will be deemed ineligible. Any other attempted form of entry is prohibited; no automatic, programmed, robotic or similar means of entry are permitted. NO PURCHASE NECESSARY. A purchase will not increase your chances of winning.
REQUIREMENTS FOR PHOTO ENTRIES:
(a) Photos must be the original work of the entrant, taken personally by the entrant.
(b) Photos must not infringe on the copyrights, trademarks, privacy or publicity rights of any person, or other rights of any person or entity. Photos cannot contain or promote the products or services of any company or entity or contain trademarks or logos, or promote any brand or product, other than WWE trademarks, logos, brands and products.
(c) Photos cannot contain content that is offensive, inappropriate, indecent or obscene, profane, or defamatory, libelous, slanderous or disparaging. Photos cannot be sexually explicit or suggestive, contain full or partial nudity, pornographic material or content that is disparaging to any ethnic, racial, gender, religious, professional or age group.
(d) Sponsor may, in its sole and absolute discretion, disqualify any photo that it believes violates any of the foregoing requirements or otherwise fails to comply with these Rules.
(e) As a condition of entry, each entrant agrees to indemnify and hold the Releasees (as defined below) harmless from and against any and all claims or liability to a third party that arises out of the content of any photo submitted in this Sweepstakes, or the entrant’s failure to comply with these Official Rules.
By submitting a photo entry, entrant grants Sponsor a royalty-free, irrevocable, perpetual, non-exclusive license to use, reproduce, modify, publish, create derivative works from, and display such entry in whole or in part, on a worldwide basis, and to incorporate it into other works, in any form, media or technology now known or later developed, including for promotional or marketing purposes. If necessary, entrant will sign any necessary documentation that may be required for Sponsor or its designees to make use of the non-exclusive rights entrant is granting to use the photo entry.
ELIGIBILITY: Sweepstakes open only to legal residents of the forty-eight (48) contiguous United States (excluding Alaska and Hawaii), the District of Columbia and Canada, excluding Quebec, who are registered Twitter users and are at least eighteen (18) years old when they enter the Sweepstakes. Entrants must own or have free access to WWE merchandise or memorabilia on or before October 23, 2012 in order to be eligible to enter or win a prize in this Sweepstakes. Employees, officers and directors of WWE (including WWE performing talent) and its subsidiaries, affiliates (i.e., entities controlling, controlled by or under common control with, WWE), promotion and advertising agencies and anyone involved in the Sweepstakes’ development or execution, including, without limitation, OneKontest and the immediate family members (meaning spouses, parents, siblings, children and their respective spouses) and members of the households of such employees, officers and directors are not eligible. By taking part in this Sweepstakes, participants agree to be bound by these Official Rules. WWE reserves the right to permanently disqualify from this Sweepstakes any person it believes has intentionally violated these Rules. Sweepstakes subject to all federal, provincial, territorial, state and local laws. VOID WHERE PROHIBITED.
DRAWINGS: There will be three (3) Weekly Prize Drawings and one (1) Grand Prize Drawing. The Weekly Prize Drawings will take place on or about each of October 29, November 5 and November 12, 2012. Weekly Prize Winners will be selected at random by Sponsor, or its designee, OneKontest, from among all eligible entries received no later than 11:59 am (ET) on the day of the drawing (for example, the entry deadline for the October 29, 2012 Weekly Prize Drawing is 11:59 am (ET) on October 29, 2012). All eligible non-winning entries from each Weekly Prize Drawing will be included in the pool of entries for the next week’s Weekly Prize Drawing. The Grand Prize Winner will be selected on or about November 14, 2012 by Sponsor (or its designee) from among all eligible entries received during the entire Sweepstakes Period. Sponsor’s decisions are final and binding on all aspects of this Sweepstakes and not subject to appeal. Limit one (1) Weekly Prize per entrant; Weekly Prize winners remain eligible to win the Grand Prize. The potential winners will be contacted by telephone and/or email within approximately three (3) business days after being selected. Winners will be required to claim their prize within forty-eight (48) hours of the time the winner notification is initially delivered. Grand Prize Winner will be required to provide additional information to confirm identity and eligibility and also may be required to complete and sign an Affidavit of Eligibility, a Liability Release and, where legal, a Publicity Release, and any other documentation that WWE may require and to see to it that WWE is in receipt of such information and documents within five (5) days of being requested to provide the same. If a selected Grand Prize Winner is a minor in his or her state, province or territory of residence at the time he or she is asked to sign any documents, the minor’s parent or legal guardian also will be required to sign the documents. In all cases, WWE reserves the right to request proof of identity, residency, age and parenthood or guardianship, and a winner will be deemed to have forfeited the prize if WWE, in its sole discretion, finds that the proof is unsatisfactory. If the entrant selected to win a prize is a resident of Canada, then he/she, in addition to all other requirements set out in these Official Rules, also must first correctly answer, without assistance of any kind, a time-limited mathematical skill-testing question to be administered at a pre-arranged time by telephone.
A prize will be forfeited and an alternate winner will be selected at random from the remaining eligible entries and confirmed in accordance with these Official Rules (i) if a potential Prize Winner does not timely provide the requisite information, return the requisite documents or cannot be reached within two (2) business days from initial notification attempt, (ii) if prize is returned as non-deliverable, (iii) in the event of non-compliance with any of the requirements of these Official Rules, and/or (iv) if the selected entrant for a prize is a resident of Canada who fails to correctly answer the time-limited mathematical skill-testing question.
PRIZES: ONE (1) GRAND PRIZE: One (1) Grand Prize Winner will receive will receive a trip for Grand Prize Winner and one (1) guest to WWE Elimination Chamber scheduled to take place on February 17, 2013 at the New Orleans Arena in New Orleans, Louisiana (the “Event”). Trip consists of roundtrip coach class air transportation for the winner and one (1) guest from the major U.S. gateway airport nearest winner’s home to New Orleans; two (2) nights’ hotel accommodations (one (1) standard room, double occupancy); roundtrip ground transportation between New Orleans airport and hotel; roundtrip ground transportation between hotel and the Event location; and two (2) tickets to the Event (seating location subject to WWE’s discretion). Approximate retail value (“ARV”) of Prize: $2,100 USD. Actual value may vary depending on airport of departure. Any difference between the actual value of the prize and the approximate retail value set forth in these Official Rules may not be claimed and will not be awarded.
Sponsor reserves the right to substitute ground transportation for air transportation in the event Grand Prize Winner resides within one hundred (100) miles of New Orleans, LA. Grand Prize Winner is solely responsible for all expenses and incidental travel costs not expressly stated in the prize description herein, including but not limited to taxes, including but not limited to, any applicable sales and income taxes, insurance, ground transportation (except as expressly provided for above), meals and beverages, gratuities, travel upgrades, baggage fees, concession items, souvenirs and personal incidentals and any other expenses not specified herein.
Grand Prize Winner and his/her guest must take air travel on same itinerary and must travel on dates specified by WWE. Lost or stolen tickets, travel vouchers or certificates will not be replaced. Once booked, no change, extension, or substitution of trip dates is permitted, except by WWE in its sole discretion. If Grand Prize Winner is from a jurisdiction that deems him/her to be a minor, he/she must be accompanied during all aspects of the Grand Prize trip by his/her parent/legal guardian, and such person must pay his/her own expenses unless deemed to be the allotted guest. If Grand Prize Winner is at least twenty-one (21) years old, he/she may be accompanied during the Grand Prize trip by a guest who is under the age of majority if: (a) the parent or legal guardian of the guest has executed an Authorization Form, giving consent, a Liability Release and, where legal, a Publicity Release, on the guest’s behalf; and (b) WWE, in its sole discretion, has granted its approval. In all cases, Grand Prize Winner’s guest or the parent/legal guardian of any guest who is a minor in his or her state, province or territory of residence will be required to sign a Liability and Publicity Release (except where prohibited by law). WWE reserves the right to request proof of guest’s age, parenthood or guardianship, and Grand Prize Winner will be deemed to have forfeited the Grand Prize if WWE, in its sole discretion, finds that the proof is unsatisfactory. Grand Prize Winner and his/her guest are responsible for obtaining all necessary and required travel documents, including, in the case of a Grand Prize Winner or guest who resides in Canada, any documents necessary for travel to and from the United States. Sponsor is not responsible if the Event is delayed, postponed or cancelled for any reason, in which event the Event ticket portion of the Grand Prize is forfeited in its entirety and no substitution will be provided except in Sponsor’s sole discretion.
THREE (3) WEEKLY PRIZES: Three (3) Weekly Prize Winners will each receive a WWE prize pack consisting of two (2) WWE t-shirts, two (2) WWE DVDs (titles selected by WWE in its discretion) and a WWE mug. ARV: $115 USD.
All expenses not specified in these Official Rules, including, without limitation, taxes and insurance are solely each winner’s responsibility. Winners shall be responsible for all applicable federal, state, provincial, territorial and local taxes including but not limited to any sales and income taxes.
Prizes may not be substituted, transferred or redeemed for cash, except by WWE, who reserves the right to substitute similar prize of comparable or greater value in its sole discretion.
ODDS OF WINNING: Odds of winning depend on the number of eligible entries received.
GENERAL CONDITIONS: Sweepstakes entrants agree to be bound by the terms of these Official Rules and decisions of WWE which are final and binding on all matters relating to this Sweepstakes. By entering, participants (and parent/legal guardian if participant is a minor) release and hold harmless WWE and its subsidiaries, affiliates, representatives, promotion, advertising and online technology agencies, prize suppliers and all others associated with the development or execution of this Sweepstakes, and each of their respective owners, shareholders, directors, officers, employees, contractors and agents (the “Releasees”) from any and all liability or any injuries, loss or damage of any kind arising from or in connection with participation in this Sweepstakes or acceptance, use, misuse or nonuse of any prize or parts thereof, including, without limitation, liability for death, personal injury, damage or loss of any kind, and from liability to any other persons relating to or resulting from entering or downloading materials or software in connection with this Sweepstakes. The Releasees do not make any warranty, representation or guarantee, express or implied, in fact or in law, relative to the use of any prize, including, without limitation, quality, merchantability, and fitness for a particular purpose. Further, no responsibilities are accepted for any additional expenses, omissions, delays, re-routing, or acts of any government or authority. WWE reserves the right to modify this Sweepstakes in any way it deems necessary or appropriate and to cancel this Sweepstakes if it deems necessary or appropriate. Entry constitutes permission for WWE and its designees to use winner’s name, likeness, performance, hometown and state for advertising and promotional purposes in any and all media at the discretion of WWE without additional compensation unless prohibited by law.
INTERNET: The use of any automated launching or entry software or any other mechanical or electronic means that permits the participant to automatically register and/or enter repeatedly is prohibited. If for any reason this Sweepstakes is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Sweepstakes for any reason. Should this Sweepstakes be terminated, Sponsor reserves the right to select the Grand Prize Winners in a random drawing from among all eligible, non-suspect entries received as of the action requiring such termination. Releasees assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Releasees are not responsible for lost, late, garbled, misdirected, or postage due entries or mail, or for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to participant’s or any other person’s computer relating to or resulting from participation in this Sweepstakes or downloading any materials in this Sweepstakes. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.
DATA COLLECTION: All personal information submitted in relation to the Sweepstakes will be handled in accordance with applicable privacy laws and the privacy policy of WWE which may be found at www.wwe.com/help/generalfaq/privacypolicy. Your personal information will only be used in connection with the Sweepstakes and as provided for in these Official Rules. The names of the Prize Winners will be made available as provided for below. Your personal information also may be used to send you additional information about WWE and its subsidiaries and each of their respective products and programs only if you provide your affirmative consent to receive such information when entering the Sweepstakes. Your personal information will not be used for any other purpose and will not be shared with anyone else.
LIST OF PRIZE WINNERS: Winning Twitter accounts will be published on onekontest.com/wwepreppers once a Prize Winner has been confirmed. For the names of the Prize Winners, available after December 15, 2012, send a self-addressed stamped envelope to: WWE/Doomsday Preppers Photo Sweepstakes, WWE Sweepstakes Fulfillment, 1241 East Main Street, Stamford, CT 06902. Requests must be received by February 15, 2013.
MISCELLANEOUS: Participants agree that this Sweepstakes is governed solely by the laws of the United States. Any claims arising out of the Sweepstakes shall be governed solely by United States law and may be brought only in a federal or state court in Connecticut. If any provisions of these Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.
