Official Rules
1. Boardwalk’s Twitter Contest (hereinafter: the “Contest”) is brought to you by Boardwalk Rental Communities (hereinafter: the “Contest Organizer”). The Contest runs in Alberta, Canada, on November 3, 2014 to November 9, 2014 (hereinafter: the “Contest Period”), or such other termination date as the Contest Organizer determines, in its sole and unfettered discretion.
Contest opens – November 3, 2014 at 12:00AM MST
Contest ends – November 9, 2014 at 11:59 PM MST
This Contest Period will run in accordance with these Official Rules and Regulations (the “Official Rules”). The Contest Organizer reserves the right, subject to any required approval of any regulatory authorities, to cancel, amend, modify or terminate this Contest or these Official Rules at any time in its sole discretion and without further notice. You must comply with these Official Rules and you will be deemed to have received, understood and agreed to these Official Rules if you participate in this Contest. Registration and number of entrants is limited as the Contest Organizer determines, in its sole and unfettered discretion.
The Contest Organizer is in no way sponsored, endorsed, or administered by, or associated with Twitter or Free the Children. Any questions, comments, or complaints regarding the Contest should be directed to the Contest Organizer.
Eligibility
2. The Contest is open to all legal residents of Canada, (or over the age of 13 if their parent(s) or guardian(s) sign a waiver) as of the first day of the Contest who have attended We Day Alberta on November 3, 2014.
2.1 Notwithstanding the preceding, the Contest is not open to individuals associated with the Contest, including the Associates of the Contest Organizer engaged in putting on the Contest, as well as any agents and representatives of the Contest Organizer, (including its respective divisions, subsidiaries, affiliates and agencies), their advertising and promotional agencies, suppliers of prizes, materials and services related to this contest or any other party directly linked to the holding of this Contest (the “Excluded Individuals”). This Contest is also not open to the immediate family members of the Excluded Individuals. For the purpose of these Official Rules, “immediate family” includes: father, mother, brothers, sisters, children, legal or common-law spouse and individuals with whom such employees, agents and representatives reside.
2.2 The Contest Organizers shall have the right at any time to require proof of identity and/or eligibility to enter the Contest. Failure to provide such proof may result in disqualification. All personal and other information requested by and supplied for the purpose of the Contest must be truthful, complete, accurate and in no way misleading. The Contest Organizers reserve the right, in their sole discretion, to disqualify any entrant should such an entrant at any stage supply untruthful, incomplete, inaccurate or misleading personal details and/or information.
2.3 Entries must be received on or before the Contest Cut-off Date in order to participate in the draw. In no event shall the Contest Organizer or Beneficiaries be obligated to award more prizes than set out in the Official Rules or to award prizes otherwise than in compliance with the Official Rules.
How to Enter
3. No purchase to enter necessary. To enter, you must have a valid, public (i.e. non-protected) Twitter account and be a follower of the Boardwalk Rental Communities official Twitter page at https://twitter.com/bwalkcommunity (@BwalkCommunity) “BoardwalkCommunities”. For greater certainty, you can become a follower by logging into your Twitter account and clicking on the “Follow” tab on the Boardwalk Communities Twitter Page. To enter the Contest, log into your Twitter account, and send a tweet to “@BwalkCommunity” using hashtag #
DoingGood. Your tweet must include “@BwalkCommunity” (a “Mention”) and the hashtag #
DoingGood so that your tweet appears in the Contest Organizer’s Mentions during the Contest Period. If you do not have a Twitter account, visit twitter.com and register in accordance with the enrolment instructions for a free Twitter account. If you do have a Twitter account, but your tweets are “protected”, make them publicly viewable by unchecking the “Tweet privacy” option in the “Security and privacy settings” and then saving your changes. No other entry method will be accepted. By tweeting your tweet to “@BwalkCommunity” using hashtag #
DoingGood, you will automatically have one (1) entry into the Contest.
3.1 Entry Limit: One entry per person, per Twitter account per day.
3.2 Any attempt or suspected attempt to enter the Contest in a fashion not authorized by these rules shall be deemed to be tampering and will void all of your entries. Entries that are late, lost, stolen, false, illegible, damaged, misdirected, mutilated, garbled or incomplete, altered or otherwise irregular or that do not conform with or satisfy any or all of these Official Rules will be void. Proof of entry transmission shall not constitute proof of receipt. Boardwalk reserves the right to refuse any entry in its absolute discretion.
3.3 Anyone found to use multiple accounts to enter the Contest will be ineligible to participate in the Contest. Use of any automated, script, macro, robotic or other program(s) to enter or otherwise participate in this Contest is prohibited and will automatically result in disqualification from the Contest. In the event an entrant tweets inappropriate content, in the sole discretion of the Contest Organizer, he or she will be disqualified from the Contest. Anyone found “spamming” by posting multiple unrelated updates, comments or pictures that are unrelated to #
DoingGood or by sending large numbers of duplicate
@BwalkCommunities replies unrelated to the Contest will be disqualified from the Contest.
3.4 By entering the Contest and submitting an Entry, each entrant (i) grants the Contest Organizer and its agents an unlimited, worldwide, perpetual, non-exclusive license and right to publish, display, reproduce, modify, edit or otherwise use the Entry, in whole or in part, for advertising or promoting the Contest or for any other reason, in any and all media, without limitation, and without further compensation or notice to, or approval or authorization by, the entrant; and (ii) waives all rights that he/she may have under laws or statutes worldwide that concern “moral rights” or “droit moral” in connection with the Entry in favour of the Contest Organizer, unless prohibited by law.
3.5 Odds of winning depend on the number of eligible entries received.
3.6 If entry to this Contest is by means of a third party service or site (a “Third Party Service”), such as a social media or social networking site, entrants must have a valid account with the applicable Third Party Service and may be required to have a public (i.e. non-private) account in order to participate. By creating an account with a Third Party Service, you agree to comply with the Third Party Service’s terms and policies. This Contest is not sponsored, endorsed or administered by any Third Party Service. In particular, all entrants acknowledge that this Contest is in no way sponsored, endorsed or administered by, or associated with, Twitter or Free the Children, and that any questions, comments or complaints regarding the Contest should be directed to the Contest Organizer and not any social media provider. By participating in this Contest, you completely release Boardwalk and all third party services of all liability in relation to any injury, damage or loss that may occur, directly or indirectly, in whole or in part, from your participation.
Prize Description
4. Entrants are eligible to win one (1) donation in their name to any registered charity or cause of their choice valued at $500.00 Canadian dollars.
4.1 Prize must be accepted as awarded and may not be transferred, sold or converted to cash. Prizing may not be exactly as advertised. The Contest Organizers reserve the right, in their absolute discretion, to substitute a prize of equal or greater value in the event of the unavailability, for whatever the reason, of any advertised prize in whole or in part.
4.2 Except as expressly warranted herein, any Contest prize is provided “as is” without further warranty of any kind.
Tweeting Format and Content
5. Each submitted Tweet must be in English or French.
5.1 Must send to
@BwalkCommunity and contain the hashtag #
DoingGood and must not, in the sole and unfettered discretion of the Contest Organizer, contain any offensive, obscene, immoral or illegal depictions.
5.2 Must be intended for family audience viewing and contain only content that, in the sole and unfettered discretion of the Contest Organizer, is suitable for all persons, including persons under the age of 13.
5.3 Must not, in the sole and unfettered discretion of the Contest Organizer, contain any nude, sexually explicit, disparaging, discriminatory, libelous or other inappropriate content; including, but not limited to, crude, vulgar or offensive language and/or symbols; derogatory characterizations of any ethnic, racial, sexual, religious or other groups; content that endorses, condones and/or discusses any illegal, inappropriate or risky behaviour or conduct (including but not limited to the use of alcohol or drugs); personal information of individuals, including, without limitation, names, telephone numbers and addresses (physical or electronic).
5.4 Must not contain any copyrighted works (other than as owned by the Entrant).
5.5 Entry cannot communicate messages or images inconsistent with the positive images and/or goodwill to which the Contest Organizer wishes to associate.
5.6 Must not contain any third party trademarks or logos.
5.7 Must not violate any law.
Draw
6. One random draw from all eligible entries received will be made by the Contest Organizer on Monday, November 10, 2014.
6.1 Decisions and rulings of the Contest Organizer and/or their representatives are final and binding without appeal in all matters related to this Contest and the awarding of a prize.
6.2 A selected entrant may be required to provide proof of identification to the Contest Organizer when claiming the prize or otherwise in connection with this Contest to facilitate the Contest Organizer’s accurate identification of a Contest winner.
6.3 If a selected entrant does not fulfill the conditions set out in these rules, or declines or forfeits a Contest prize, the Contest Organizer reserve the right, in their discretion, to cancel the Contest prize, to select another entrant from the remaining eligible entries pursuant to the process described in this section, above, or to donate the Contest prize to a charity of their choosing.
6.4 If you use Twitter via a wireless mobile device, standard text messaging and/or data rates may apply for each message sent or received from your device. Other charges may also be applied by your wireless carrier. Participation by wireless mobile device is not a condition of entry.
Awarding the prize
7. The Contest Organizer will attempt to contact selected entrants by private message on Twitter within 24 hours of being selected to confirm identity, obtain contact information so that a declaration and release form (the “Release Form” or if under the age of 18 and over the age of 13 a parent(s) or guardian(s) signed waiver) and the skill testing question can be administered and to confirm that the selected entrant is a Prize Winner.
7.1 To be declared a Prize Winner, a selected entrant must (a) correctly answer without assistance of any kind, whether mechanical or otherwise, a mathematical skill testing question posed by mail or telephone or email, and (b) sign a Release Form if over the age of 18 or signed waiver from a parent or legal guardian if under the age of 18 and over the age of 13, which, among other things: (i) confirms compliance with these Official Rules, certifying eligibility, (ii) confirms acceptance of the Prize as awarded, without substitution, (iii) releases the Contest Organizer, subsidiaries, divisions, advertising and promotion agencies, the Independent Contest Organization, and all of their respective agents, employees, directors, officers, shareholders, successors and assigns (collectively, the “Releasees”) from any liability in connection with the Contest and the Prize (including the use and/or misuse), any portion thereof or this Contest or any event or party held in connection with the Contest (including Free The Children and Twitter), (iv) agrees to the use of his/her name, address (city and province/territory) and/or photograph and confirms that each Invitee has consented to the use of their name, address (city and province/territory) and/or photograph, in all cases without further remuneration, in connection with any publicity carried out by or on behalf of the Contest Organizer with respect to the Contest.
7.2 If a selected entrant (a) cannot be reached by reasonable efforts within seven (7) days of being selected; (b) fails to correctly answer the mathematical skill testing question, (c) fails to return the properly executed Release Form or parental signed waiver, or (d) otherwise is not in compliance with these Official Rules; then he/she will be disqualified and another entrant will be randomly selected from among all remaining Eligible Entries for that Contest Period until such time as contact is made with the selected entrant or there are no more Eligible Entries, whichever is earlier.
7.3 The Contest Organizer will not be responsible for failed attempts to contact a selected entrant.
7.4 The Release Form will be emailed to each selected entrant and must be returned within the time period specified on the Release Form or the Prize will be forfeited. The Prize will be coordinated by the Contest Organizer with the winner upon receiving the fully completed Release Form.
Release of Liability / Consent to Publicity
8. By accepting the Contest prize, the winner: confirms compliance with these Official Rules; acknowledges that the prize is not transferable (except as provided for herein and only at the Contest Organizer’s absolute discretion) and must be accepted as awarded or otherwise except where stated; consents to the use of his/her name, city of residence, entry, voice, statements, photographs and/or other likenesses for publicity, advertising or informational purposes in any medium or format carried out by the Contest Organizers and/or their advertising agencies regarding the Contest or the prize, without further notice or compensation; and releases each of the Contest Organizers, their affiliates, advertising and promotional agencies, the suppliers of materials or services related to the Contest, and all of their respective shareholders, directors, officers, employees and agents (collectively the “Releasees”) from and against all liability in connection with the Contest and/or the awarding and/or use of any Contest prize.
Governing Law
9. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of the entrant or the Contest Organizer in connection with the Contest shall be governed by and construed in accordance with the internal laws of the Province of Alberta and the federal laws of Canada applicable therein without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other laws.
Limitation of Liability
10. The Releasees do not assume any responsibility and each entrant releases the Releasees from any and all claims, actions, damages, demands and liabilities of whatever nature or kind arising out of or in connection with the entrant's participation or attempted participation in the Contest and any Contest prize, including, without limitation the administration of the Contest, the selection and confirmation of any Contest winners, and the arranging, awarding and use of any Contest prize.
10.1 The Contest Organizer will not be liable for any failure of any Contest related website, and do not assume any responsibility for incorrect or inaccurate capture of entry information, technical malfunctions, human or technical error, printing errors, lost, delayed or garbled data or transmissions, omission, interruption, deletion, defect or failures of any telephone or computer lines or networks, computer equipment, software or any combination thereof. The use of an invalid email address or Twitter account will disqualify all entries from those users/email addresses/Twitter accounts. In the event it is determined that an entrant has entered in a fashion not sanctioned by these Official Rules and/or has submitted more than the number of entries permitted by these Official Rules, the entrant will be disqualified and all of the entries submitted by the entrant will be disqualified.
10.2 In the event of any discrepancy or inconsistency between the terms and conditions of these Official Rules and disclosures or other statements contained in any Contest-related materials, the terms and conditions of these Official Rules shall prevail, govern and control to the fullest extent permitted by law.
Privacy
11. By entering this Contest, each entrant consents to the collection, use, and disclosure of his/her personal information for the purposes and in the manner described herein. All information submitted by entrants is being collected by the Contest Organizer and is subject to the Boardwalk Rental Communities’ Privacy Policy, available at http://www.bwalk.com/en-CA/Home/Privacy.
11.1 In connection with prize fulfillment, the Contest Organizer may be required to provide your personal information to another party, including, but not limited to, any other Contest Organizer. By entering the Contest, you consent to such disclosure of your personal information in connection with the foregoing, and you understand and agree that, should your personal information be provided to another party, your information will be subject to that party’s privacy policy and information handling standards and practices.
11.2 You further acknowledge and agree that, where you enter a Contest by means of a Third Party Service, any personal information that you share with, or by means of, such Third Party Service may also be used by the applicable Third Party Service in accordance with its own privacy policy.
General
12. This Contest will be run in accordance with these Official Rules, which shall be subject to amendment by the Contest Organizer without notice or liability to you. Entrants must comply with these Official Rules and will be deemed to have received and understood these rules by participating in this Contest. The terms of this Contest, as set out in these rules, are not subject to amendment or counter-offer, except as set out herein..
12.1 The Contest Organizers reserves the right to cancel, modify, or suspend this Contest or to amend the Official Rules at any time and in any way, without prior notice, for any reason whatsoever. Without limiting the foregoing, if for any reason the Contest is not capable of running as originally planned, for example as a result of tampering or infection by computer virus, bug, corruption, security breach, or other cause beyond the reasonable control of the Contest Organizers, reserves the right to the Contest Organizer to cancel or suspend the Contest and/or conduct a random draw from all previously received eligible entries.
12.2 If a dispute arises regarding the identity of any online entrant, the online entry will be deemed to have been submitted by the authorized account holder of the Twitter account provided at the time of entry. A selected entrant may be required to provide proof that he or she is the authorized account holder associated with the selected entry. All online entries must be submitted from a valid Twitter account.
